Terms and Conditions for Online Auction & Sales Services
These Terms and Conditions govern your use of the online auction services provided by Global Business valuers and Auctioneers Pty Ltd, an Australian Valuation and Auctioneer business (ABN 91 058 491 964) By registering for and using the Service, you agree to be legally bound by these Terms, which may be updated or amended by us from time to time, in accordance with Australian law.
1. Registration and Account Use
a. To participate in any online auction, you must first register for an account by providing accurate, current, and complete personal information, including your full name, address, email address, and valid contact number. Registration is free and does not obligate you to place bids or make purchases.
b. Providing false, misleading, or incomplete information is strictly prohibited and may result in the suspension or termination of your Account. If your details change, it is your responsibility to update them immediately. We are not liable for any consequences resulting from your failure to provide updated and accurate information, including misdirected invoices or failed communications.
c. During registration, you must create a unique username and password. You are solely responsible for maintaining the confidentiality and security of your login credentials. Any action taken under your Account will be deemed to have been made by you, whether authorised or not. You must notify us immediately if you suspect unauthorised use or a security breach.
d. We may send you email notifications including but not limited to:
• Status updates on active bids
• Confirmation of winning bids
• Purchase receipts and invoices
• Delivery and collection instructions
• Promotional materials (unless you opt-out)
• Customer satisfaction surveys
While we aim to send timely updates, we do not guarantee delivery or receipt of any communications. We are not liable for any losses incurred due to missed emails.
e. We collect, use, and store your personal information in accordance with our Privacy Policy, which complies with the Privacy Act 1988 (Cth) and Australian Privacy Principles (APPs). Your personal data will not be disclosed to third parties without your consent, unless required by law.
f. You may request closure of your Account at any time, provided there are no outstanding bids, unresolved transactions, or unpaid balances. Closure requests must be submitted via email.
g. We reserve the right to suspend, restrict, or permanently close an Account at our sole discretion if you breach these Terms or engage in unlawful conduct.
2. Bidding Obligations
a. By placing a bid, you are making a legally binding offer to purchase the item. If your bid is the highest at or above the reserve price, you become the Winning Bidder and are obligated to pay the full amount due.
b. Once submitted, bids cannot be withdrawn or modified. This includes Autobid settings, which automatically place incremental bids up to your maximum specified limit.
c. Prior to bidding, you must read the full item description, including any terms listed in the Lot Page, Sale Overview, or associated documentation. Images, titles, and summaries are for reference only and do not constitute a full description or warranty.
d. You must not engage in or attempt to engage in bid manipulation, including bidding on your own items, collusion, or using multiple accounts to influence auction outcomes. Such behaviour will result in termination of your Account and may be referred to relevant authorities under the Competition and Consumer Act 2010 (Cth).
e. Inspection is highly recommended and available during schedule viewing times or by appointment. By placing a bid, the bidder acknowledge they have the opportunity to inspect or waive their right to do so and accept the item as is, where is, in its current condition.
f. These conditions apply to all auctions. By placing a bid, the buyer accepts these terms. Buyers are required to pay the full purchase price by the specified due date and are solely responsible for the removal of purchased items within the designated time frame following payment confirmation.
3. Payment Terms
a. If you are the Winning Bidder, you are required to pay the following (“Invoice Amount”):
• Winning bid amount (exclusive of GST)
• Buyer’s Premium (percentage outlined in the Sale Information). In accordance with the Auction Terms and Conditions, an additional buyer’s premium applies. Please refer to the lot description for specific details.
• GST (as required under A New Tax System (Goods and Services Tax) Act 1999 (Cth))
• Any additional charges, including but not limited to delivery, insurance, handling, or storage fees
b. Payment methods:
• Electronic Funds Transfer (EFT)
• Direct deposit or bank cheque (for invoices over AUD $5,000)
• Other approved methods, by prior agreement
Full payment must be received within three business days of auction closure.
c. Failure to pay:
• We reserve the right to cancel your purchase, resell the item, and charge the greater of $250 or 20% of the Invoice Amount as a cancellation fee.
• Deposits or part payments may be forfeited.
• We may pursue legal action to recover losses, including lost commission, storage costs, and other administrative expenses.
d. Payment of invoices is required in full within three (3) days from the invoice date. Non-compliance with this payment obligation may also result in Account suspension, legal recovery proceedings and notification to credit reporting or regulatory agencies and additional costs incurred by the buyer.
e. Collection is only available after payment has been verified on Global’s end. Once payment is confirmed, our team will contact you to arrange a collection time or collection must occur during the allocated collection period. Additional fees may apply if items are not collected within the scheduled timeframe.
4. Conditions of Sale
- The highest bidder (subject to reserve) is deemed the purchaser.
- The auctioneer may reject or refuse any bid, withdraw items, or reopen bidding in case of disputes.
- A minimum deposit of 10% is payable immediately upon winning a lot.
- The remaining balance must be paid within 36 hours. All goods must be removed by the deadline specified in the sale information.
- Goods are sold “as is, where is” without warranty. It is the buyer’s responsibility to inspect items prior to bidding.
- Risk transfers to the purchaser upon the fall of the auctioneer’s hammer.
- All costs and logistics for disconnection, removal, and transport are the buyer’s responsibility.
- Removal must be supervised by the Vendor or authorised agent. Buyers must avoid causing damage.
- Shortages in quantity may result in pro-rata refunds only if claimed at the time of delivery.
- Non-compliance results in forfeiture of payments and liability for any resale loss.
- The auctioneer may place bids on behalf of the Vendor.
- All prices are GST inclusive.
- Electrical goods may not comply with current safety regulations. Buyers must ensure certification by a licensed electrician.
- Entry to premises is at your own risk. Neither the Vendor nor Auctioneer accepts liability for personal injury, death, or damage. Buyers must hold appropriate public liability and workers compensation insurance.
- The Buyer’s Premium varies by auction and is detailed in the Sale Information.
- An additional bond may be required for building and demolition lots.
- Buyers must obtain all required permits and comply with laws including:
• Work Health and Safety Act 2011 (Cth and relevant State Acts)
• Building Code of Australia
• Environmental and planning laws
• Mineral Resources Act 1989 (Qld) and similar legislation in other states - Occupational Health & Safety Notice: Some equipment may lack compliant safety features. Buyers must ensure all plant and machinery complies with relevant OH&S requirements before use. Plant Risk Assessments are available for inspection.
- Personal Property Securities Registrations on Encumbered Assets (PPSR)
• Some assets in this sale may have existing PPSR registrations. The removal of these registrations can take between 1 to 6 weeks, depending on the holder’s response time. We cannot guarantee the exact time frame for PPSR clearance.
• We are instructed to sell the assets in clear title unless advised otherwise. After full payment is received, the vendor will liaise directly with PPSR holder to arrange the removal of the registration. Buyers acknowledge and accept this timing risk when purchasing any encumbered item.
5. Governing Law and Disputes
These Terms and Conditions are governed by the laws of the State of Queensland any disputes shall be resolved through appropriate dispute resolution processes or by courts within that jurisdiction.
